Washington lawmakers are considering a bill that would ban smoking in cars containing people younger than 18-years-old. This comes two years after voters approved a ban on smoking in public places statewide. I am 63 years old, 4 years older than my father in law when he died from lung cancer. I stood there along the bedside of this person, to whom I have felt fortunate to have known,
2 hours before he died watching him gasp for air, as if someone had sucked every bit of oxygen out of the room.
Two weeks ago, I found out a dear friend of mine, who being about 20 years less than me in age, had smoked probably half of her life was diagnosed with lung cancer, and four lumps in her brain, estimated to have 6 to 9 months to live.
Do I think young people should start smoking?
Do I think people who smoke should quit?
Do I think that parents should smoke in enclosed areas with minors who have no choice?
Circumstances can certainly sway ones thoughts.
People who smoke know they are throwing the dice.
All of my life I have heard cigaretts called "cancer sticks". Why do life insurance companys quote two rates, smokers and non smokers. People who smoke have the right to smoke. It's their body and they have the right to do anything that they want to it. But they do not have the right to infringe upon non smokers the harmful side effects of second hand smoke? The smaller the containment, the greater the danger.
For the last few weeks while the stock market tanks, the war in Iraq goes on and inflation combines with the raging subprime fiasco several really stupid laws have been proposed by those elected folks who haven't yet learned how to do anything right. This is one unnecessary law.
I am totally against anyone smoking in a car with children. Both of my parents were heavy smokers. They both smoked in the car while I was growing up. I complained all the time that I couldn't breathe and it made me sick. I always seemed to have upper respiratory infections and chronic bronchitis.
I am wondering how are parents raised us without the government telling them how to do it???
If the State of Washington wants to protect kids by banning smoking in cars, fine - as long as they ban bottles of soda pop in cars (bad for kids) and, in fact, ban our kids from ever being in our cars or in our homes at all as they both contain foreign formaldehyde and other poisonous materials deadly to kids (and adults) as they're not regulated like home-grown poisonous products for our homes. Maybe they should just ban us from having kids at all unless we place them with the State to raise them at its own cost?
This smoking law is stupid! these people are interested in one thing YOUR MONEY between there stupid laws,overtaxation,and the way they waste the money they steal from our checks every week they should all be fired for their incompitience
I believe that we should not smoke in cars with children under age of 18 We adults have to speak for the children who have no concept of the things that can hurt them they do not have the power to say don't do that with me in hear since most parents wouldnt listen to them anyway.
Honestly, this is the most ridiculous law yet. Ya know people, if you let them pass this law now why don't you just allow them to ban smoking in your own house, you know what? why not just take an extra step and let them put video camera's in there too so they can track our every move and take our money when we smoke at all. Listen, we have already had too many of our rights taken away, what do you call the patriot act? And what about this? have any of you guys heard that they are going to start putting radio chips in our licenses so they can track us? They cover it with a simple excuse of "We're trying to prevent identaty fraud" but then again Bush covered the real reason he went in Iraq with a "They have weapons of mass distruction" I mean come on, these and the small suttle steps people (Government) are taking to control us, why should we allow this? If we do let them cross that line why don't we just toss the constitution and put computer chips in our brains so they can know if we're thinking something "out of sorts" I watched my Grandpa die of cancer from smoking, he had cancer of the liver, stomach and brain, that doesn't change the fact that I think this law is completely out of line.
I AGREE SMOKING IS VERY BAD,So is the fast food markets, Alcohol, floride, bleach, fuel, processed foods, chemically grown foods, animals, scissors, knives, guns, water(chemically treated), lightbulbs, electricity, vehicles, airplanes, there ARE so many VERY BAD things in the WORLD we NEED to just BAN it ALL! How in the heck did our ancestors EVER survive! We should BAN all the bad so we all could go sit in our little white rooms.

First they said the no seatbelt law was going to be an infraction which was secondary. Meaning that you would not get pulled over for it. As we can all see today that has obviously changed.
I say that the legislature should spend their time and money working on how my taxpayer money is spent instead of wasting time and money legislating common sense out of our society.
The society is not all comprised of mindless borgs who smoke with their kids in the car and we don't need to spend millions of dollars to tell people this. We don't need a nanny looking over our shoulders at every turn.
Tell those legislators that we're tired of them wasting time on "issues" like this. We don't need to follow what they think as their leadership... California lawmakers. If they continue along this path Washington will be just as screwed up as California in 20 years.
1) Our government should ban smoking in the car if the there is a minor inside.
2) We also should ticket those people throw the cigarette butt or spitting gum on the street. $100 per incident should be good.

Every law sets a precident. We need to think of what will be next. Will the government make laws preventing those who choose to smoke in the privacy of their own home from doing so if they have a child? Will we have a 'smoking police' go to smokers' homes to see if they are smoking with small children present? I realize the purpose of this proposal is to protect our children, and we need to do so within reason. However, we can only reasonably do so much until the 'freedom line' has been overstepped and we might as well give our children to the government to raise. Smoking isn't healthy for adults or children, but I cannot support this proposed ban, because it steps on the freedom of those who choose to smoke within the confines of their own car.
While I do not smoke and I know of the hazards of smoking for all of us, I would oppose the government at any level being empowered to restrict smoking in a personally owned vehicle, regardless of the occupants. Where will they stop? The next logicdal step would be for the government to outlaw smoking in your home if children were present. Then what? The solution for every malady that affects mankind seems to be to empower the government to control more and more of our lives. This is not the freedom our founding fathers had in mind when they prepared the constituion. Personal responsibility needs to be reinforced and supported. It seems absolutely unbelievable to me that we spend so much time and effort to protect our children after they are born, but willing allow the rapant killing of unborn children under the guise of protecting the mothers right to choose. What about the childs rights to life, liberty and the pursuit of happiness guaranteed by our constitution? Right is right and wrong is wrong and it is not that difficult to tell the difference to any thinking person!
I am a non smoker so perhaps I have a bias about the stench and effects of cigarette smoke.
That being said, if you witnessed a 6 month old baby being physically abused by it's mother you would (normally) do something to protect that infant. You would not go away from the abusive incident thinking the parent had every right to whatever she wanted in the privacy of her car.
Society has to intervene in circumstances where parents do not put the well being of their child first. Cigarette smoke causes all kinds of respiratory problems and children who come from homes have a far higher significance of all kinds of illnesses. Why should society have to shoulder the cost of ER visits for uninsured kids due to smoke related illness, kids who are sick at school and smell of smoke? If parents can't resist exposing thier children to carcinogens, then perhaps the law should step in to protect them!
I smoke I would love to quit, If the government wants to do something because people smoke, why don't they pay for the treatment for the people who would like to quit. This way they are helping more people ones who want to quit, and the ones that don't smoke less people smoking around them and kids. The government isn't taking something away they are actually helping. I hate the government telling us what to do smoking in the car to not smoking in business establishments, when and if quit I will still think people should have there freedom.. Alchol is just as bad but I see people getting away with it as I imagine most the government drink so..... it's glorified commericals and billboards all advertising the enjoyment of drinking... People who smoke in cars roll down their windows to take the smoke out of the air...
I don't think this law would prevent the kids getting exposed to the second hand smoke. You can ban smoking in the cars with passing these kind of laws but the question is how you are going to stop those parents smoking in the homes while watching tv with their kids. Either way those kids whose parents smoke will be exposed to the cigarette. The government should educate the parents first of all. I used to be a smoker but never smoked in the house regadless of any of my kids in or not, or in the car while my kids travelling with me. This is a tough issue. Parents would have to be more responsible and should not expose their kids to the second hand smoke.
I think this is such a waste of legislative time-there are way more important issues to tackle. I also think government can give guidlines but should not be the enforcer.
so some of you are saying the government doesn't have the right to tell you what you can and can not do in your own personal car. Does this mean that you have the right to down a 6-pack of beer behind the wheel? no! it doesn't! Anyone who says that it is an invasion of their personal property has a flawed argument. The car is being used on public roads paid for by tax dollars. So you are on public property therefore the government has every right to say what can and cannot be done there. If you want to smoke in your car... park it in your driveway and light up.
This is a bogus law and thread; as proposed this law would make it a secondary offense for minors under 18 to be smoking in a car. To get emotions up on the issue the NWCN sound bite showed someone in favor of it stating something to the effect that children getting emphysema from second hand smoke is a cost burden to all of us and this law is necessary. The opposing statement showed someone who I don't think looked under 18 stating it violates her rights... and so emotions are now fired up over saving the children and personal privacy. Here we go with another touchy-feely garbage law that's a waste of time, money and a distraction from real issues.
As for youth under 18 smoking while driving, it's already illegal for anyone under 18 to be in possession of tobacco in Washington state see RCW 70.155.080, why do we need a redundant law? Why not enforce the ones we already have. Laws set precedent's for future laws and this is a very dangerous one. Someone made the statement that the state has the right to impose on our privacy rights by comparing smoking to drinking alcohol while driving? Comparing drinking and driving to smoking is not a valid argument, you can't seriously make that comparison because all things are not equal. The restrictions on driving and drinking are there because alcohol impairs your judgement and response time and can effect other drivers. Comparing smoking in a car to drunk driving trivializes the very real danger of drunk driving. The statement that the government has the right to say what can and cannot be done on public roads is correct except we are the government, we choose what the government can and cant' do by electing others to represent us and the issues we vote on. We have all the right in the world to say what the government can and can't do and the government needs to answer to us not the other way around.
Individual privacy rights used to and should still make it out of line for the state to decide what you can do in your private vehicle concerning a legal substance that doesn't effect others whether your on a public road or not. Besides it's asinine to believe you can legislate the danger out of everything, come to your senses people stop the useless laws that set precedent's before we lose something a lot more important than a false sense of security or a warm fuzzy feeling brought on by more useless laws on our books.
How about outlaw it completely on the road?
People and their personal choice and their "rights". So nice I'm free to say so.
1.It is a nice message to the kids to know that that they have health rights. Make it happen.
Young people pick up on alot.
2. We legislate all these safety of things pertaining to the automobile-car specs, standards, tires/mirrors/ect. Things to make OTHER people safe on the road. Yet, parking lots outside of bars? Let's do that next.
3. Ironically, I smoke. It is my disease. And a gift of my wonderful pierce county 'parents'. Sometimes in the car. But with kids it is a no brainer to pull to a parking lot-and get out; or to keep it outside. I don't want to be forced to breathe another persons fart for instance.
It's bad enough they have to watch me killing myself-they don't need to watch me kill them too.
4. People who throw their fire out the window make me as angry as the idiot who's making traffic a danger by talking on thier cell phone.
Only, I don't wish the person on the cell phone to for instance, die. I only wish they'd 'grow up' and start acting like the mature person they are pretending to be.
5. I knew someone who a smoker while driver. Our practiced norms of it being 'expected behavior' to both drink and to drive away afterwards resulted in the deaths of others who were likely completely sober and just trying to get home. Like I am all the time. Though the impact was likely enough. It was likely a cigarette lit the fuel.
6. These kind of rules are sometimes the only way that I know that for instance, I may have basic human rights equal in comparason to those of my compatriots who will whine and cry to get their way using the constitution as an excuse to protect and negate their blantant criminal and immoral behavior.
Are we going to smoke on the road? How about not? I know more people would say no as to yes, and that those who would say yes do so only to 1. protect (ahhh) "our inalienable rights (insert violin) or
2. smoke.

My only concern, if the law were to *properly* progress to
total on the road ban on smoking is the commercial trucking industry. Their home is basically on the road. It seems logical for them to be exceptioned.

Here we go again! Apparently the government doesn't have enough to do! I do not smoke anymore, however, I have a real problem with the government trying to take over our lives. First the banning in bars (where 99% of the people who went to then smoked) and restaurants. Now they want to say what we can do in our cars. This is just the beginning of government taking charge of our lives. The next step they will come into your homes and tell you what you can and connot do there. Letting them into our cars is just the second step in controlling our lives. Next they will want to pass a law that people cannot cannot have sex in their homes because "the children might see". If you don't see what the government is doing you really need to open your eyes. I do not support smoking but I do support not allowing the government trying to rule my life with their so called "laws".

Instead of worrying about people smoking in their cars. They should be worried about cleaning the air up that WE ALL breath in. It's loaded with toxins and chemicals. Clean our air up first!

In 2005, I.901 was passed which ban cigarette smoking outside of buildings within 25 feet from doors,windows,ventilatios,etc. Here comes another intrusion from the government into the private lives of its' citizens with [S.B. 6287 & H.B. 2519]-banning smoking inside our own cars. These bills state that this infraction is a "SCONDARY ACTION", what this means, is if the law enforcement cannot find any other traffic violations while you are in motion or the car is not in motion, they can sight you with this infraction. There is no other reason why any one should be receiving a "traffic ticket" if they haven't violated some moving violation while driving down the road, or indocication reasons. These bills are just another reason for a traffic cop to pull a car over tha issue a ticket.
In 2009, 2010, 2011,or 2012, is the government going to proposing to banned smoking in private homes when children are present ? This is the next logical progression to become a communist state.
well seems like the only ones sniffling about this one are the smokers.Do common sense laws seem silly yes they do Is it silly that people can`t use common sense on their own !!???? Wake up people !!!
it seems like a no brainer like talking on the phone while driving but............about 10 years or so back there was an article beyond any normal thinking where some montanna law makers had to stop what they were doing to pass a law because some religous group drank animal urine during thier so called services. the law could only cover minors but the adults, well bottoms up! stupid yeah but will it stop? not completely. that all falls in that group of stupidness like having to pass a law in washington state against having sex with animals after some guy died from having sex with a horse.
The problem is not that the proposed law is silly (which it is). The problem is not that it is a waste of our tax dollars (which it is). The problem, also, is not because it is letting Big Brother into our personal cars (which it does). the problem, as I see it, is that we continually go down the road of catering to the lowest common denominator.
We make laws and rules and policies and basic decisions based on how they will affect (sorry but it must be said) stupid people with no common sense.
Do I smoke? Yep. Do I have kids? Yep. Do I smoke in the house or in my car when the kids are present? No. Never have, not even once. Do I smoke inside the house when the kids aren't there? No.
Please enlighten me if there is a study or research that has some good facts but I believe that we are talking about the vast minority of smokers out there who actually force their children to be closed up in the car when they are smoking.
My point, and I believe the point that a lot of the people claiming "civil liberties" is, why don't laws get passed that actually punish the people who have no common sense? Why is it that a law must be passed that could possibly effect everyone when the people who need to be stopped basically aren't going to care anyway?
Question: How many times have you driven down the road, only to encounter someone driving that leaves you wondering "How in the world did that person get a driver's liscense?"? Yet, we all know, that when that person's liscense expires, they go right down and get a new one. Why don't we just make it tougher to obtain and keep your driver's liscense? Why don't we make it law/policy that you must re-take your drivers exam in order to renew your liscense? Say every two years you must pass the written and every four years you must pass the actual on-the-road driving test? Oh, I know, because it would cost the government too much money to staff their DOL appropriately. So instead of spending money to actually provide a service and keep unsafe drivers off the road, we spend all the money in legislation that will do nothing to keep the offenders from offending. Just like drunk drivers that continue to drive, people who smoke with kids in their car are going to smoke law or no law. All this is is another Band-Aid to make our elected officials feel good about themselves, yet does NOTHING to fix the problem. I mean really, you get caught smoking with the kids in the car and what happens? You pay a fine and the Government makes money. The cop gives you the ticket, they get out sight and they are going to light up again. They say that this is to keep the children safer, yet it really has no hope of accomplishing that.
If I thought that the ban on cell phones or smoking would elliminate the hazzard, I would gladly be all for it. However, all these laws are going to do is end up putting more money into the Government without fixing anything. If they are really had up for the cash, hold a freakin' bake sale.
since I'm paying taxes and those are going to be used to care for those that decide to smoke I'm all for banning smoking all together. Ban the stuff.
If we allow them to do continue to invade our privacy what will be next. Will we allow them to tell us that we can't smoke in our own homes. I'm sure that there are alot of other things that need to be fixed in this state. I grew up with a parent that smoked in the house in the car with no ill effects. I also smoked and raised to strong boys with no problems. If your children are sensitive to smoking then don't smoke around them. It is just common sense and we don't need a law requiring us to stop smoking in our own vehicles.

No smoking in cars? No smoking in public places? Hmm. Years ago it was determined that cigarettes cause cancer. Sooooo, what should be done? Think maybe making them illegal after this was discovered? Sure that would make it tough on people who smoked at the time (though I'm sure many would be able to find what they needed elsewhere) BUT it sure would have made it better in the future, ie way fewer NEW smokers. So why didn't they make them illegal? TAXES/money. Too much tax money lost. So they keep them legal, more and more people get cancer and new smokers replace the old smokers. But of course the smokers have to be limited to where they can smoke. Public places, no (probably a good idea but good luck to taverns). Automobiles? Good luck with that, a person's home and car are their "castles" as far as I'm concerned, if cigarettes not illegal can smoke in your home or vehicle. Interesting tax bill lately too. Free health care for low income children. Nice concept, all kids should be entitled to health care. But where will money come from? Everyone should bear the responsibility right? Or if they need to single out a specific group maybe higher income families who have children. BUT instead they choose to tax a totally unrelated group, SMOKERS. Fair right? Why not people who wear red shirts? Smoking sucks, should be illegal, instead they keep it legal for the tax money then treat smokers unfairly by taxing through the roof, how can a pack of cigarettes which probably costs 50 top 75 cents to produce cost $4-10 in a store, it's all tax. And telling people where they can consume this LEGAL PRODUCT. Ban them, but if not quit cheating the people who are saddled with the addiction.
Like i said whats next, what we do in our homes? This is stupid, theres more important things to worry about.

Yet these are nothing more than parlor tricks to make us believe we've a government looking out for us. What this bill will mean is that police officers will have yet another means of making revenue. It's one of those funny things you realize as you drive down the freeway. As much as the government wants you to be law-abiding citizens they actually want you or rather need you causing infractions so that they can penalize monetarily. This is what this is. They want yet another means of penalizing you. Why not then ban cigarettes outright rather than collect taxes on a very product that's been proven to be dangerous. The claim of being worried over the health of the youth of Washington what is being done to prevent the behavior of smoking in front of youth to begin with? Why not then make it law to have parent take classes. It seems we're all very apt to make law dealing with consequences and dealing with the aftermath of a person's behavior and very happy to try and make a dime out of it. Why then can we not take preventive matters as well? We need to support these causes as well otherwise this law will be seen as what it was really set up for, and that simply wanting people to commit infractions so that they can get some revenue.

Well now isnt that just the stupidist thing you ever heard? You bought the car, not the government, next they will say you cant smoke in your house, or better yet, you cant smoke outside in the open air outside your house, you will have to do it in the privacy of your garage, or somthing like that, oh I know they will make you build your own little smoke house with ventilation and everthing.......MAD yes I am, I am a former smoker, but give me a brake!!!!! What next you have to put a government camera in your car so you can get caught???? I actually had a friend the other day got a ticket for no seat belt, however the reason they pulled her over was because she had flipped ashes out her window...In the State of Washington that is a 1000 dollar fine....The government need to keep thier nose out of certain things.....had to vent...

I'd bet that the carbon monoxide,exhaust, and other assorted fumes,vapors,emmissions, etc., that spew out of each and every car, truck, SUV, bus, semi-rig, motorcycle, motorhome, service vehicle, train, boat, ferry, airplane, and helicopter, cause far more harm to kids than the cigarette smoke, since most of it gets sucked right out the partly open car window when someone smokes in a car...If children's safety is truly the issue of concern, we should pass a law that restricts them from riding in any motor vehicle that isn't hermedically sealed, with it's own encapsulated oxygen purification system, and only on roads with a maximum speed limit of 20mph, because, (of course), "children are present"! If the over-paid officials would put as much effort into balancing the budget, and reducing the national debt, and protecting the planet from extinction due to global warming, and ending the war in Iraq,( you know, the stuff we are paying them to do?), instead of trying to see just how far up our asses they can stick their noses, maybe we tax-payers could actually afford some of lifes little luxuries, such as, health insurance, food, decent housing, more education for ourselves, and our kids...isn't it funny how the government in Russia is slowly becoming more people based, while, here, in the "land of the
free", it's getting more, and more, based on the personal agendas of a handful of people? And, now that a vast majority of us between ages 35-55, have, at some point in our lives, exercised poor judgement, and have had some contact with a law enforcement agency, many of our age group are not allowed to vote on the issues, directly effecting our personal lives and our communities. Taxation without representation...isn't that what prompted the birth of our country? ...is it "Tea Time" again? I think most of us would agree that if we were to do our jobs as half-assed as most of our elected officials do, our bosses wouldn't put up with it, they'd give us "the boot", and we'd deserve it! Why should the people our tax dollars reward with a fat salary and benefits package, have to live up to our expectations, or find themselves praying for a new job before they run out of unemployment checks? I don't need our elected officials in my living room, local restaurant, and bar, or the back seat of my car...I want to know they are hard at work in the State Capital, or City Hall, or in Washington D.C., proving they deserve to be there! That shouldn't be expecting too much...
This country is over regulated and under run ! When the government learns how to run itself efficiently and get a hold on the national debt, then it can tell me when, where, and how to live my life !

People complain about their rights, but they are not worried about the kids who sit there and suck in the poison. It is truly a poison. Do we allow our kids to take a swig off a bottle of drain cleaner? I think that this law is vital. We have people out there who are selfish and care more for the instant gratification that a cigarette offers, and they ignore the long term devastation on their little ones.
I believe it is a concern but I'm really tired of the Government constantly trying to pass laws such as this and not be so concered about our elderly, medical costs, heating costs, gasoline costs, etc..... As it stands anyone who is a smoker has been critized and banned from public places such as bars, bowling center, restuarants and even OPEN AIRED parks! Yes, I smoke and yes I always ask if my smoking bothers the person I may be around and respect them but don't start telling me I can't smoke in a car that I paid for, insurance I pay for and tabs I pay for! The minute the Government start this, they won't stop there - it'll be "you can't smoke in your home or yard!" If the Government wants to truely help then put those cigarette taxes we pay for to good use like helping reduce the price people pay for kicking the habit because I don't see all the tax money going anywhere but into someone's pocket(s).
The Government does not Fuck me Feed me raise my kids or pay my bills. I am certainly not going to heed to this bs bill. The day the government decides it is going to pay my bills car payment ETC then the can tell me where to smoke. Next they will be telling us what to wear as it may affect the ozone. This bill is as much a joke as Ohbama running for president. Is funny though, we tear down the wall in Germany, only to put one up here in the usa.
Remember, smokers have rights too. Ever wonder if smokers banned together and fired all those who don't smoke what would happen. Smokers can do the same to non smokers as they do to us smokers. Think it is stupid, well so is this law that they are trying to pass. Just another loss for smokers. And will I treat non smokers differently if law passes? Yes, I would.
